Estate Planning and Probate

Bowen, Radabaugh & Milton, P.C. represents individuals and business owners in a wide array of estate planning matters.  We strive to comprehensively meet the needs of each client, so that they come away feeling comforted in the knowledge that should anything happen to them, their families will be well-provided for and their wishes will be met.

Wills & Trusts

Wills are a type of estate planning device allowing individuals to delineate the manner in which they want their estate to be distributed after their death.  Our estate planning attorneys examine the different types of assets that are within your estate, and help you determine how best to have those assets distributed, taking into consideration such matters as tax implications.

Trusts allow individuals to designate the manner in which they want their assets to be distributed.  However, with a properly created and funded trust the assets do not require probate administration, which is discussed below.  Our attorneys will discuss your estate planning options with you and help you decide which approach is best suited to your needs and concerns.

Probate Administration

Probate is the process by which the court oversees the administration of the decedent’s estate, ensuring that final expenses to creditors and any taxes that are owed are paid, and that the decedent’s assets are distributed properly according to his or her will. Our experienced lawyers will make sure that your will is properly submitted to the court and that any issues or disputes that may arise are expeditiously resolved.
